Real Estate Professional Status

Real estate professional status is a tax designation that, if met, allows an investor's rental real estate losses to be treated as non-passive rather than passive, potentially permitting those losses to offset active income such as wages or business profits. Qualifying generally requires spending more than half of one's working hours and a substantial number of hours per year materially participating in real property trades or businesses, a bar that most passive investors in syndications will not clear on their own. A spouse's qualifying hours can sometimes be combined with a couple's overall real estate holdings, which is a strategy some households use deliberately.

Because the hour and participation requirements are strict and fact-specific, real estate professional status is more commonly pursued by full-time property managers, developers, or investors with a concentrated portfolio of directly managed assets. For most passive syndication investors, the more relevant framework is understanding general real estate tax efficiency strategies that work within, rather than around, the passive activity rules.
